1. RIVER BOAT TRIP

TERMS AND CONDITIONS OF SALE

Boat trip aboard the VALDESIR

Article 1 — Purpose and Scope

These Terms and Conditions of Sale (“Terms”) apply to all bookings and ticket purchases made with LEVALDESIR, operator of a river cruise service aboard a 12-passenger boat on the Yonne river and the Nivernais canal.

Any ticket purchase implies full and unconditional acceptance of these Terms.

Article 2 — Bookings

Passengers must book their excursion in advance. It is advisable to book as early as possible, given the limited number of seats on board.

Bookings are accepted:

  • Online via our website
  • By email for private boat charters, with payment by bank transfer
  • On site, subject to availability

Any specific health condition must be disclosed at the time of booking. Pregnant women and persons with a disability, physical condition, or any health issue are required to report this when booking.

Article 3 — Prices and Payment

Prices are shown in euros, inclusive of all taxes, and are available on our website: www.levaldesir.com

For private boat charters, payment must be made 15 days before the trip to confirm the booking.

Accepted payment methods: credit card, bank transfer, and cash.

Article 4 — Cancellations and Refunds

By the customer (individual):

  • Cancellation more than 48 hours before the date: full refund
  • Cancellation within 48 hours or less: no refund

By the customer (privatisation)

  • Cancellation more than 15 days before the date: full refund
  • Cancellation within 15 days or less: no refund

By LEVALDESIR:

  • Online purchases are non-refundable and non-exchangeable, except in the event of cancellation by the operator (bad weather or technical issue). In that case, the customer will be fully refunded or may reschedule the booking to another date.

Article 5 — Weather Conditions and Route Changes

Announced departure and arrival times may be brought forward or delayed if the captain encounters any difficulty. Weather conditions may require the captain to alter the planned route. In all cases, passengers will be kept informed of any changes to schedules, prices, or routes.

Article 6 — Boarding and Safety

Passengers must arrive at the boarding point 15 minutes before the scheduled departure time. Late arrival may result in forfeiture of the reserved seat, with no refund.

All passengers must comply with the rules and safety instructions set by the crew.

The captain reserves the right to refuse boarding to any person:

  • Who is visibly intoxicated
  • Whose behavior poses a danger to other passengers
  • Whose health or physical condition is deemed incompatible with the trip given the day’s weather conditions. In such cases, the passenger will be fully refunded.

Minors must be accompanied by a responsible adult.

Article 7 — Liability

The operator accepts no liability for failure to follow safety instructions, or for loss, theft, or damage to personal belongings, particularly in connection with the boat’s movements or weather conditions.

Passengers are liable for any damage they cause on board or to third parties.

Article 8 — Personal Data (GDPR)

Data collected during booking (last name, first name, email, phone number) is used solely for managing your booking. In accordance with GDPR, you have the right to access, rectify, and delete your data.

Article 9 — Mediation and Disputes

In the event of a dispute, an amicable solution will be sought first. Failing that, you may use the free consumer mediation service.

French law applies.

2. WINE TASTING

BOOKING AND PAYMENT
All bookings must be accompanied by full payment for the service. Payment by bank transfer or credit card.

CANCELLATION TERMS
Cancellation at least 15 days before the service date: full refund.
Cancellation less than 15 days before the service: full amount of the service will be charged.
To be valid, any cancellation must be made by email, mail, or phone, and confirmed by the managers of AU JARDIN CLOS.
